Terms and Conditions for Artists

An offer has been made to you (the Artist) to exhibit up to three pieces of artwork (unless otherwise agreed with your Art House Tour Representative in writing) at the 2026 Art House Tour (the Art House Tour) hosted by Auckland Grammar School Foundation Trust (the School). This document sets out the details of the Art House Tour and the rights and obligations of the School and the Artist. 

The Art House Tour is held primarily within the Grammar school zone with a few additional houses located in Herne Bay and surrounding areas. Your artwork will be exhibited at one of the Tour Houses or at The Gallery (which is situated on the School premises). The Art House Tour is a ticketed event which is open to the public. The Art House Tour will take place between 10:00am-4:00pm on Saturday 21 November 2026. The Gallery will also be open for viewing and sales between 9:00am-5:30pm on Friday 20 November 2026.

  1. Registration: The Artist must complete the registration form on the Art House Tour website. The Artist registration and participation in the Art House Tour is subject to these Terms and Conditions.
  2. Provision of Information: The Artist agrees to provide the School the following content by no later than the dates specified:
    • Biography: By no later than Friday 26 June 2026 – a 50-word biography and a cover image of your artwork, which will be contained in the Art House Tour Catalogue
    • Imagery: By no later than Friday 28 August 2026 – high-resolution electronic images of each piece of artwork to be exhibited. You agree that all images supplied may be used in the Art House Tour programme brochure and all social media content relating to the Art House Tour
    • By no later than Friday 28 August 2026 – the title, dimensions, medium and price of each artwork being submitted
  3. Website/Internet Gallery/Publicity: The Artist agrees that the School may publish biographical details and images of work submitted by The Artist on the Art House Tour website and in any other associated marketing material prior to, during and after the Art House Tour.
  4. Originality: The Artist warrants that each artwork submitted by The Artist to the School is The Artist’s original work and does not infringe any copyright or any other intellectual property right.
  5. Indemnity: To the fullest extent permitted by law, the Artist indemnifies the School, its agents, officers, employees and representatives (the Indemnified Persons) against all claims, loss, damage and costs, suffered or incurred by any Indemnified Person arising out of, or in connection with, your artwork and any content that you have provided to the School.   
  6. Presentation of Artwork: The School shall endeavour to display your artworks to their best advantage. To assist in such display, you shall ensure the following:
    • Paintings must have hooks and string or wire on the back to enable hanging.
    • Each work must be clearly labelled by the Artist with the artist’s name, the title of the work, the medium and the price.
    • Each piece should be wrapped to adequately protect it during storage and transportation. Please do not use expensive packaging as we are unable to return this.
    • Any special display requirements for object d’art or other ‘out of the ordinary’ pieces must be requested by the Artist in advance for consideration by the School.
    • Special Hanging Requirements: If any of the Artist’s artworks are particularly delicate or have special hanging or display requirements, the Artist must make arrangements with the School’s Development Office to install their own works.
  7. Delivery of Artwork: The School will inform the Artist of the location of your artwork (being a Tour House or The Gallery) by no later than Friday 6 November 2026.  The location is at the School’s sole discretion. The Artist must deliver their artwork to the allocated location on the date and between the times as follows:
    • Tour House: Friday 20 November 2026, between 11:00am-1:00pm
    • The Gallery: Thursday 19 November 2026, between 9:00am-11:00am (through Gate 4, Auckland Grammar School, Mountain Road).
    • If the Artist lives outside Auckland, the Artist must courier their artwork (together with a return courier envelope) to the Auckland Grammar School Development Office (delivery address: Auckland Grammar School, Property Services 55 Mountain Road, Epsom  Auckland 1023), by no later than Friday 13 November 2026.
    • If delivered by courier, please mark the outside of the package with the address above, and label it with Attention: Auckland Grammar School Art House Tour, with your name and ‘Artist’ and ‘Art House Tour’.
    • The School may, at its discretion, change the courier location, in which case the School will give the Artist adequate notice. The School is not liable in any way in the event that the Artist’s artworks do not arrive at the agreed-upon destination within the time frame stipulated above.
  8. Receipt of Artwork: The School will issue a receipt for all artwork received. The receipt will state the Artist’s name, the title of each artwork delivered and the price each artwork is to be sold for. It is the Artist’s responsibility to check the information contained on the receipt as a true and correct record. If no response is received from the Artist within two days of the receipt being issued, the receipt shall be accepted as being an accurate record of the information contained within it. If work is couriered, the School will issue an e-receipt for all artwork received.
  9. Collection of Unsold Artwork: The Artist, or their nominee, must collect any unsold artwork from the same location as the delivery, on Saturday 21 November from 4:00pm-5:00pm. Artwork will not be available for collection before 4:00pm and will only be released to the Artist or their nominee with the receipt (refer to clause 8). The Artist will be informed by a designated Tour committee member by no later than 4:00pm which of their artworks have been sold and which are to be collected.
  10. Post-tour sales: The School shall offer ticket holders the opportunity to purchase any unsold artwork via the Art House Tour website for a period of up to three days following the conclusion of the Art House Tour. If an artwork is sold via this method, it is your responsibility to arrange, with the buyer, delivery or collection of the sold artwork.
  11. Sale Price and Commission: 
    • The Artist is responsible for setting the price of their artwork
    • The price shall be inclusive of GST (if any)
    • The School shall collect the price upon the sale of an artwork, and such sale proceeds shall be allocated as follows: 60% of the price (inclusive of GST) to you and 40% of the price (inclusive of GST) to the School as commission
    • Each party is responsible for any tax on their respective amounts received upon the sale of an artwork
    • While reasonable efforts will be made by the School to collect the sale price, the School will not be held responsible for any uncollected funds
  12. Payment: The Artist’s proportion of the sale proceeds, being 60% of the sale price, shall be paid to the Artist on the 20th of the month following your confirmation of the invoice. The payment shall be made by direct credit to the bank account specified by the Artist in the registration form. The School is not responsible for any incorrect bank details provided by the Artist. 
  13. Ownership, Risk, Handling, and Insurance: The School and its representatives will endeavour to take care when handling and displaying the Artist’s artwork. In addition, the School maintains monitored security to ensure the safety of all of its buildings and equipment, and additional security services will be employed throughout the Art House Tour period at the Tour Houses. Notwithstanding:
    a. The artworks remain the Artist’s property and risk in the Artist’s artworks remains with the Artist up to and including the collection by the Artist (or their nominee) or buyer (as the case may be).
    b. To the fullest extent permitted by law, the School has no responsibility whatsoever for any loss of and/or damage to any artwork during the period from its delivery to and including the collection by the Artist (or their nominee) or buyer (as the case may be).
    c. The Artist is are advised to insure your artwork and to let your insurer know the details of your participation in the Art House Tour, and in particular, the location of your artwork (either in storage or on display at your allocated location as advised by the School)
    d. Notwithstanding anything in these Terms and Conditions, but subject always to the School’s obligation to pay the Artist’s proportion of the sale price under clause 11, the risk of, and title in, any sold but uncollected artwork will pass to the School upon the School making the relevant payment to the Artist. To the fullest extent permitted by law, the Artist waives all contractual, statutory and other rights and claims in relation to such artwork upon receipt of the payment.
  14. Dealer Gallery Relationship: It is the Artist’s responsibility to inform their dealer/gallery (if any) of their participation in the Art House Tour.
  15. Marketing: The School will promote the Art House Tour through all of its available marketing and media channels and may feature the Artist’s artwork. The Artist will promote their participation in the Art House Tour through all their available marketing channels including social media (which must include a minimum of five social media posts prior to the Art House Tour, either through a post, a story, or a reel). All such marketing communications must refer to the ‘Art House Tour, proudly supported by [sponsor TBC]’. The Artist does not need to obtain approval from the School for the marketing content in connection to the Art House Tour but must tag @arthousetour and #arthousetour in each post so the School can repost accordingly.   16. Presence: Where the Artist’s artworks are located in a Tour House, you agree to be on site from 10:00am-4:00pm (or at an alternate time agreed upon in advance in writing with the School) during the Art House Tour, to speak about the Artist’s work with attendees. During this time, you will conduct yourself in a professional, courteous and respectful manner. If you are unable to be on site, please email arthousetour@ags.school.nz in advance of the Art House Tour.
  17. Right of Refusal: The School reserves all curatorial discretions in respect of the artworks and in particular the right to make the final decision regarding the selection and display of artwork submitted, and reserves the right not to hang work due to size/quantity submitted/previously exhibited paintings or any other reason, and may, in consultation with the Artist, review the suggested price for any artwork. If, despite the School making reasonable endeavours to agree with you on the sale price of an artwork, we are unable to reach an agreement on the sale price, the School reserves the right to exclude the relevant artwork from the Art House Tour.
  18. Postponement or cancellation of the Art House Tour: If, in the reasonable opinion of the School, an event occurs that prevents the School from proceeding with the Art House Tour on the dates and/or in the manner proposed, the School reserves the right to consider all options reasonably available to it in modifying, suspending, cancelling or carrying out the Art House Tour, including, but not limited to, proceeding with an online sale of the artwork on the proposed or alternative dates, or postponing the Tour while storing the artwork at its chosen location or locations. For the avoidance of doubt, an ‘event’ referred to in the foregoing sentence includes any circumstance beyond the reasonable control of the School, including without limitation, fire, flood or other extraordinarily severe weather conditions, acts of God, government policy, war, riot or armed conflict, acts of terrorism, pandemics, epidemic or other known medical or public health emergency, or any other event with similar effect to the foregoing.
  19. Termination: The School may remove the Artist and the Artist’s artwork from the Art House Tour at any time, at the sole and absolute discretion of the School. Where this occurs, no compensation will be payable to the Artist.
